California Leads Country in Number and Amount of Dog Bite Insurance Claims in 2012

Dog_bite_ins_Claim.jpgMuch has been made recently regarding the reaction of the insurance industry to the high number of claims being filed in response to dog bite attacks.  Some insurance companies are limiting the types of breeds that they will cover for their policyholders and others are all but discontinuing coverage for dog bites.  Clearly, this action taken was in response to numbers that did not look good on the balance sheets of insurance companies, and we now have some statistics that could help to explain what is happening in the background.

Every year, the Insurance Information Institute and State Farm Insurance come together to provide several different types of statistics regarding the number of claims filed for different purposes and the amounts paid for claims overall and on a per-claim basis.  The Insurance Information Institute has recently released the data relating to dog bite claims filed and amounts paid during the calendar year of 2012, and California was far and away the leader in both categories.

Alarming Dog Bite Fatality Statistics Released, 2005-2012

b2ap3_thumbnail_Dog_Bite.jpgFor many years now, www.DogsBite.org has been compiling annual statistics on breeds involved in fatal dog accidents.  The organization has now released its compiled data for the years 2005 to 2012.  This data shows several important trends regarding fatal dog attacks across the United States.

In both the 7- and 8-year compilations, pit bull dogs accounted for 60 percent of recorded deaths.  Texas led the nation in total dog bite fatalities with 32 in the relevant period, 75 percent of which were caused by pit bulls.  California had slightly fewer deaths at 28 but a higher percentage of pit bull attacks, with 82 percent of fatalities caused by this breed.  The three states with the next highest incident rates were Georgia with 16, Florida with 14 and Michigan with 12.

Bishop arrested in hit-and-run DUI accident

b2ap3_thumbnail_dui-hit-and-run.jpgA Massachusetts bishop and leader of a Roman Catholic diocese has been arrested in connection with a hit-and-run accident in Rhode Island and charged with driving under the influence of alcohol, according to police sources.

The 61-year-old bishop, who is the head of the Worcester Diocese, was arrested in Narragansett when the driver of a vehicle he allegedly struck followed him as he left the scene of the accident. The driver called the police who found the bishop at his vacation home and arrested him.

The bishop has promised to accept the consequences of what he calls a “terrible error in judgment.” He claims he was drinking wine at dinner before getting behind the wheel of his car. The bishop declined a blood alcohol test and will also be charged with that refusal.

How to Deal with Property Damage After a Bicycle Accident

Police Dog Attacks

These dogs are used by police departments across the country to find and apprehend criminals and to locate drugs or other contraband substances. However, the law requires that K-9s be under control at all times and not be allowed to menace or attack innocent bystanders. How could a well-trained police dog bite an innocent victim? The answer is that there are several ways this situation can arise.

First, a K-9 is under control of an officer or “handler” who gives the dog its commands. The handler and dog work together for many months not only to learn the commands but also to develop a trust relationship in which the dog is highly motivated to obey the handler. Most K-9s will only respond to the commands given by a particular handler, although some are trained to work with more than one officer. Therefore, the handler has a very serious responsibility to keep the dog under control. If the officer fails in this role, an attack on an innocent victim can happen.

Nestle USA Recalls Two National Frozen Pizza Brands

When Should I Settle My Motorcycle Accident Case?

Can an undocumented immigrant recover damages after a car accident?

Robert Weaver Injured in a Roseville Accident

Roseville Police have arrested a 45-year-old Lincoln woman on suspicion of gross vehicular manslaughter after a chain reaction collision in Roseville Tuesday afternoon. A Roseville man was killed in the crash, and his wife remains in a serious condition in a local hospital.

The updated report in The Roseville Patch says Jordan Tonya Peters, 45, a lawyer from Lincoln, was driving erratically in the eastbound lane of Pleasant Grove Boulevard Tuesday, at around 3:40 p.m. At a point between Pioneer Road and Roseville Parkway, Peters’ car smashed into a vehicle that was stopped at a red light. The impact was so severe, it caused a chain reaction which ultimately damaged five vehicles.

Reporting Dog Bites

According to public health services, only one in 64 dog bites is ever reported to authorities, even though California dog bite law provides remedies for victims of dog bites. This failure to report becomes a public health issue and problem for several reasons. We always encourage victims to report each and every dog bite to help keep others safe from dogs that are repeat biters. For Sacramento area residents, the number to call to report a bite is l 916-368-PETS (7387).

One of the biggest reasons that it is important to report every dog bite that breaks skin is that dogs that bite rarely stop at one incident. Theoretically, by the time a dog bites you, it may have bitten several other people before. If all of those people felt it would be “wrong” to report the dog and owner for biting behavior, future incidents would be most likely occur. Until someone officially reports a dog bite, it is unlikely that any action will be taken to curb that dog’s behavior.

By law, animal bites must be investigated. Bite investigation does not automatically mean the animal is impounded - it may only mean that vaccination and licenses are verified. This helps us protect public health and safety.

New Study Reveals Special Brain Cells May Play Recovery Role After Injury

The astrocytes are produced from the stem cells that are present in the brain.  They migrate to an area of trauma and may be effective at speeding recovery.  The study focused on mice, although researchers are in hope that the same phenomenon can be true in human injuries, as well.

Global Recall of 3.3 Million Cars Due to Faulty Airbags

What Is Wrong With These Airbags?

The airbags in question are at risk of catching fire.  Specifically, the airbag in the front passenger seat of affected vehicles may not inflate correctly due to a propellant error.  As a result, there is a strong risk of fire resulting from the propellant or of passengers being injured by flying metal that could be ejected from the airbag housing. The possibility of a fire or metal shrapnel pose significant risks to drivers and passengers of these vehicles that should be taken seriously by anyone owning one of these cars.

The Land of Nod Recalls Plush Dollies Due to Choking Hazard

Unfortunately, the nearly uniform belief regarding the safety of plush dolls may have to come to an end, as one of the leading companies that makes these toys has recently announced a voluntary recall of thousands of units from the market because of a choking hazard. Specifically, the affected units have hands that can be detached from the rest of the doll and potentially swallowed by small children. This poses a direct choking hazard and therefore makes these dolls unfit for consumers.

Johnson & Johnson Prevails in Second Hip Implant Trial

Nevada Assembly Passes Bill Allowing Lane Sharing By Motorcyclists

Supporters of the legislation claim that it will cut down on rear-end motorcycle accidents, while opponents believe the danger to both motorcyclists and drivers will be increased by allowing this practice.

Assembly Bill 236 has now passed the Transportation Committee with only two members opposing it. The bill would make Nevada the second state after California to allow “lane filtering” or lane splitting, which is a common practice in other countries.

A Glimpse of Hope for Personal Injury Victims with Chronic Regional Pain Syndrome

Carter's has been one of the leading providers of clothing for infants and small children in the United States, and the company recently announced a recall of 218,000 units of clothing because of the potential for the zipper to come loose, thereby presenting a choking hazard. There are eight different brands of clothing that are subject to this recall, and according to the Consumer Product Safety Commission the size involved are infant as well as 3, 6 and 9 months.

Legal Definition of an Act of God

The term “act of God” is applied to any event that causes damage or harm but which is not precipitated by human action.  For example, the damage caused by a hurricane is not due to a human being driving drunk or failing to maintain safety standards.  However, there is a fine line between damage caused by an act of God and damage caused by neglect of a foreseeable problem that is exacerbated by the accident.

The Best-Kept Secrets of the Auto Industry

The auto maker claims that there are no “unique tire issues” involving Ford or Mercury vehicles.  However, it is almost impossible to validate this claim, because any information Ford submits to the NHTSA can be requested by the company to be kept confidential.

NHTSA normally posts information on its website about potential defects and statistics for injuries or deaths resulting from formal or official investigations.  However, if the agency agrees to an “informal” investigation, this information may not be available immediately to the public, leaving consumers in the dark about potentially fatal defects in vehicles.

Arden Way Accident Kills a Man

head-on-collisionA teenage driver was killed and a 24-year-old man was seriously injured Saturday in an early-morning head-on crash on Arden Way, in the Arden-Arcade area of Sacramento. Police say they believe drunk driving is what triggered the crash.

The report on Sacto 9-1-1 says Augustin Valdovinos-Ocampo, 19, of Sacramento, was westbound on Arden Way in a 1994 Nissan pickup truck at about 4:30 a.m. last Saturday. At a point just to the east of Bell Avenue, Valdovinos-Ocampo crossed over the center line and into the eastbound lanes.

The Nissan smashed head-on into a Chevy truck being driven by an unnamed 24-year-old male. When emergency responders arrived on the scene, the discovered that the driver of the Chevy had suffered serious, potentially life-threatening injuries. He was rushed to a local hospital.

Valdovinos-Ocampo did not survive the crash. He was pronounced dead at the scene. According to CHP Officer Liz Dutton, they believe Valdovinos-Ocampo was drunk at the time of the crash.

Drunk driving continues to plague the roads and highways of the Sacramento area, and indeed the country as a whole. Clearly, more should be done to stop intoxicated drivers from getting behind the wheel of a vehicle, where they represent a horrible danger to both themselves and other road users.

This accident has now severely impacted two more Sacramento-area families. Valdovinos-Ocampo has paid the ultimate price, but the young man who was driving the Chevy truck also has to deal with a number of very serious issues. Who will pay his medical bills? What about the lost income from time off work? Will he require ongoing treatment, and if so, who pays for that? Worst of all, what happens if, God forbid, he doesn’t recover; how will his family keep going, financially and emotionally?

If it is proven that Valdovinos-Ocampo was at fault for this tragic accident, his insurance company could be held liable for the other man’s medical bills, lost income and pain and suffering. The injured man or his family would be well advised to seek the help of a competent and experienced Sacramento personal injury attorney. A good attorney will advise the family how to go about making a claim and what to do in the event the at-fault driver was either uninsured or under-insured.
