The so-called "Fairness in Asbestos Injury Resolution Act" was a bad bill when it came out of committee - and it is changing for the worse as it gets closer to a vote in the Senate.
The wrongly named "Class Action Fairness Act" would give corporate wrongdoers the right to move cases against them to federal court, even when the case is based entirely on state law. Federal courts already have huge backlogs. This bill would only make the situation worse, as Chief Justice Rehnquist and the Judicial Conference of the United States have noted.
Big Business wants Congress to pass class action "reform," but there is no need or demand for this! Both the federal and state judiciaries oppose efforts to federalize state class actions. Class action "reform" is simply about limiting the rights of consumers to seek redress against wrongdoers.
Although the insurance companies weren't successful in their recent attempts to pass a bill capping medical malpractice awards, they will probably be back soon with a similar bill, claiming it will help keep their insurance premiums down for doctors. Since when do insurance companies want to lower their rates? The only time they do that is when the market is competitive and they feel like they are in danger of losing market share.
